Abstract

Human life can not be separated from the the need of water. In order to accommodate the people’s need in usage of natural resources, the state has enacted Law No.7 of 2004 concerning Water Resources. The Law is aimed at regulating, the protecting the rights of citizen to get water to fulfill everyday minimal basic needs for healthy, clean and productive life, includes to give protection from the risk result from the potential and water sources. However, Law No.7 of 2004 then has been annulled by Constitutional Court through its decision No. 85/PUU-XI/2013. This annulment brings impact the deletion the opportunity for privatization and commercialization of Water Resources management that may harm the people’s interest. The consequence is that the authority for water sources management is returned to the state. This article is discussing the model of water resources management after the annulment of Law No. 7 of 2004 in its relation with the constitutional recognition of Adat Law Community (Masyarakat Hukum Adat). Its relevance for West Sumatera is that Nagari that has Property, not only land as Nagari’s Land Property (ulayat nagari), but also water, forest, plants, mine, animals and other natural resources. Therefore, in in its principle, Adat Community that has the Nagari’s Property that has right to exploit its property especially water resources.
